Welcome to Fynk, a subscription tracking app designed to help you master your subscriptions and reclaim your money. These Terms of Service govern your access to and use of Fynk's mobile application, website, and any related products or services.

IMPORTANT: Fynk helps you track your subscriptions and cut the waste. We analyze your existing bank transaction data to find recurring payments and help you take action, but we are NOT a bank, payment processor, or financial institution. We do not handle, process, or facilitate any financial transactions, payments, or money transfers.

By using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not access or use our services

1. Description of Services

Fynk is designed to help users track their subscriptions and cut the waste by securely analyzing financial transaction data. Our smart tech understands your subscriptions through integrations with certified third-party APIs such as Quiltt.io or Basiq.

The user journey is straightforward. First, you connect your account by securely connecting your bank and letting Fynk analyze it to find any recurring payments. Next, you review the results to see where your money is going each month. Finally, you can cancel what you don't use by reviewing cancellation instructions for each service or requesting our help.

Our features include automated identification of recurring charges and subscription services, spending analysis showing insights into where your money is going each month, cancellation assistance with instructions and support to help you cancel unused subscriptions, and smart technology that understands your subscriptions and helps you take action without the hassle.

What we do: We securely connect to your bank to analyze transaction data, find recurring payments and subscriptions, help you review where your money is going each month, provide cancellation instructions and assistance, and let our smart tech do the work without the hassle.

What we do NOT do: We do not process payments or financial transactions, act as a bank or financial institution, provide financial advice or investment recommendations, store banking credentials or passwords, initiate financial transactions on your behalf, or guarantee successful subscription cancellations.

2. Eligibility and Account Registration

Our services are intended for users aged 18 and older, or the age of legal majority in your jurisdiction, whichever is higher. By using our services, you represent that you meet these age requirements.

To use certain features, you must create an account. When you do, you agree to provide accurate, current, and complete information during registration, maintain and keep your account details updated and accurate, keep your password and credentials secure, take responsibility for all activities that occur under your account, and notify us immediately if you suspect unauthorized access.

You may use third-party login providers like Google, Apple, or Facebook to create or access your account. Email and password authentication is also available. By using third-party login, you authorize us to receive limited profile information as permitted by that provider's policies, acknowledge that your relationship with the third-party provider is governed by their terms, and understand that we are not responsible for the third-party provider's practices.

3. Financial Account Integrations

To provide financial insights, you may choose to connect your financial institution accounts via secure, certified third-party APIs. By connecting your accounts, you grant permission for Fynk and its certified partners (such as Quiltt.io or Basiq) to access and analyze your transaction data for subscription tracking and analysis. You understand that data access is read-only and limited to information necessary for our services, and acknowledge that connections use industry-standard security protocols.

Your banking credentials are transmitted directly to certified banking API providers, never to Fynk. We do not store, access, or have visibility into your banking passwords. All data transmission is encrypted using bank-level security standards, and you can revoke access to your financial data at any time.

We are not affiliated with, endorsed by, or acting on behalf of any financial institution. Our service is independent and not sponsored by your bank or credit union. Financial institutions are not responsible for our services or any issues arising from their use.

You remain solely responsible for complying with your bank's terms of service and account agreements, monitoring your accounts for accuracy and unauthorized activity, maintaining the security of your banking credentials with third-party providers, understanding that we cannot guarantee the accuracy of transaction categorization, and verifying any subscription-related information we provide.

4. Subscription Plans and Billing

Certain features of Fynk are only accessible with a paid subscription. Subscriptions are managed and billed through third-party platforms, including RevenueCat, Apple App Store, and Google Play, and they are billed directly through our website at getfynk.io. For mobile app purchases, pricing may differ from website pricing. We do not process payment card information directly, and all transactions are subject to the billing and refund policies of the respective platform.

Subscriptions are charged on a recurring basis according to your selected plan and are subject to automatic renewal unless canceled before the end of the current billing cycle. Prices and features may change with proper notice as outlined in these Terms.

Payments for subscriptions purchased directly via our website are processed securely through our certified payment processor. We may store limited billing metadata such as subscription type, dates, and payment method type, but we never store complete credit card numbers or security codes.

5. Refund Policy

We offer a 14-day money-back guarantee for subscriptions purchased directly via our website at getfynk.io. This guarantee applies to new subscriptions purchased through getfynk.io, subscription upgrades purchased through getfynk.io, and must be requested within 14 days of the original purchase.

To request a refund, contact support@getfynk.io within 14 days of purchase and include your account email and reason for refund request. Refunds are processed within 5-10 business days and issued using the original payment method.

This guarantee does not apply to subscriptions purchased through Apple App Store or Google Play, which are subject to their respective refund policies and procedures, subscriptions purchased through third-party platforms, requests submitted after the 14-day period, or accounts suspended for Terms violations.

In certain circumstances, we may offer pro-rated refunds at our discretion for technical service failures lasting more than 48 hours, billing errors on our part, or service termination by us for reasons other than Terms violations.

6. User Content and Feedback

You may submit data, feedback, suggestions, or other content through our services. By doing so, you provide Fynk a worldwide, non-exclusive, royalty-free license to use, modify, and incorporate your feedback, confirm you own or have necessary rights to share such content, and understand that feedback may be used to improve our services.

Your content must not violate any applicable laws or regulations, infringe on third-party intellectual property rights, contain malicious code or harmful content, or include sensitive financial information beyond what's necessary for our services.

We may, at our sole discretion, remove any user content that violates these Terms or applicable law, poses security risks to our platform or users, or contains inappropriate or harmful material.

7. Intellectual Property Rights

All content, trademarks, software, and functionality of our services are owned by or licensed to Fynk and protected by copyright laws and international copyright treaties, trademark laws and regulations, trade secret and proprietary rights laws, and other applicable intellectual property laws.

You may not copy, distribute, or modify any part of our services except as expressly permitted, reverse engineer, decompile, or attempt to extract source code, use our trademarks or branding without written permission, or create derivative works based on our services.

We grant you a limited, non-exclusive, non-transferable license to use our services for their intended purpose, subject to these Terms.

8. Communications and Notifications

Fynk may send you various types of communications. We may send SMS and text messages for subscription confirmation and cancellation updates, account security alerts and notifications, and service-related announcements and updates. We may also send push notifications for subscription reminders, price changes (including trial endings), cancellation confirmations, and marketing offers. Message frequency varies and standard carrier rates may apply. You can opt out through app settings or by replying "STOP".

We may also send push notifications for real-time alerts about subscription changes, billing reminders, payment notifications, security alerts, and account activity updates. Push notifications can be managed through device and app settings, and you can disable them entirely while still using our services.

Email communications include account verification and security notifications, customer support responses, service updates, feature announcements, and marketing communications with opt-out available.

You may opt out of marketing communications by clicking "unsubscribe" in email communications, updating preferences in your account settings, or contacting support@getfynk.io. You cannot opt out of essential service communications.

9. Prohibited Uses and Conduct

You agree not to engage in prohibited activities. Technical violations include attempting to gain unauthorized access to our systems or other users' accounts, using automated tools to access or interact with our services beyond normal usage, interfering with or disrupting our services or servers connected to our services, and introducing viruses, malware, or other harmful code.

Content violations include using our services for illegal activities or to violate any applicable laws, submitting false, misleading, or fraudulent information, impersonating another person or entity, and harassing, abusing, or harming other users.

Commercial violations include using our services for commercial purposes without authorization, reselling or redistributing access to our services, and using our services to compete with or harm our business interests.

Violations may result in a warning or temporary suspension, permanent account termination, legal action where appropriate, or cooperation with law enforcement.

10. Service Modifications and Availability

Fynk reserves the right to modify, update, or discontinue features at any time, implement new terms or conditions with appropriate notice, update pricing with advance notice to existing subscribers, and improve security measures and technical infrastructure.

We strive to maintain service availability but do not guarantee uninterrupted or error-free service. We may experience planned maintenance windows, cannot control third-party service provider availability, and are not liable for service interruptions beyond our control.

For planned maintenance, we provide advance notice when possible; for emergency maintenance, we provide notice as soon as reasonably possible; and for major changes, we provide 30 days' advance notice via email or in-app notification.

11. Account Termination

You may terminate your account at any time by using the account deletion feature in the app, contacting support@getfynk.io with a termination request, or following any other termination procedures we provide. When you request account deletion, we will mark your account as deleted in our database and process the deletion according to our Privacy Policy.

We may suspend or terminate your account for violation of these Terms, fraudulent activity or misuse of services, non-payment of subscription fees, legal or regulatory requirements, or extended inactivity with notice.

Upon termination, your access to our services will end immediately, we will delete your personal data according to our Privacy Policy, financial account connections will be severed, subscription fees are non-refundable except as specified in our refund policy, and certain provisions of these Terms will survive termination.

12. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING:

Technical warranties: We do not warrant uninterrupted, timely, secure, or error-free service, complete accuracy of subscription detection or financial analysis, compatibility with all devices or operating systems, or freedom from viruses or other harmful components.

Financial analysis disclaimers: We do not guarantee complete or accurate subscription identification. Transaction categorization may contain errors. We are not responsible for missed subscriptions or billing errors. Results may vary based on data quality and account complexity.

Third-party disclaimers: We do not control or guarantee third-party service availability. Financial institutions may block or limit data access. Third-party API changes may affect service functionality.

No financial advice: Fynk does not provide financial, investment, tax, or legal advice. Our services are for informational purposes only. You should consult qualified professionals for financial guidance.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYNK WILL NOT BE LIABLE FOR:

Excluded damages: We are not liable for indirect, incidental, consequential, or punitive damages, loss of profits, revenue, data, or business opportunities, emotional distress or reputational harm, or costs of substitute goods or services.

Specific exclusions: We exclude liability for financial losses due to subscription billing errors not caught by our service, damages from third-party service failures or data breaches, losses from reliance on our financial analysis or recommendations, and unauthorized access to accounts due to third-party vulnerabilities.

Damage cap: Our total liability for any claim shall not exceed the greater of $100 USD or the amount you paid for services in the 12 months preceding the claim.

Essential services: Some jurisdictions do not allow limitation of liability for essential services. In such cases, our liability is limited to the minimum extent required by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Fynk and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses including reasonable attorney fees arising from your use or misuse of our services, your violation of these Terms or applicable laws, your breach of any third-party rights, content you submit through our services, and your financial account connections and related authorization.

We will promptly notify you of any claim requiring indemnification, allow you to control the defense or settlement with our approval, and provide reasonable cooperation in the defense.

15. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact support@getfynk.io to describe your concern, allow us 30 days to investigate and respond, and participate in good-faith efforts to resolve the dispute informally.

If informal resolution fails, both parties agree to resolve disputes through binding arbitration. Arbitration will be conducted under the rules of a recognized arbitration organization, with arbitrator selection by mutual agreement or organization appointment, in remote proceedings unless parties agree otherwise, and under the governing law specified below.

Exceptions to arbitration include small claims court actions within jurisdictional limits, injunctive relief for intellectual property violations, and violations of these Terms requiring immediate action.

Class action waiver: YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR JURY TRIALS.

Limitation period: Any legal action must be commenced within one year after the cause of action accrues, or be forever barred.

16. Governing Law and Jurisdiction

These Terms are governed by and interpreted under the laws of Cyprus, without regard to conflict of laws principles.

For any disputes not subject to arbitration, Cyprus courts have exclusive jurisdiction, you consent to personal jurisdiction in Cyprus, and any legal proceedings must be conducted in English.

You are responsible for complying with applicable local laws in your jurisdiction when using our services.

17. International Users

While Fynk is available internationally, certain features may be limited based on local banking infrastructure and API availability, regulatory requirements in your jurisdiction, and currency and language support.

By using our services, you consent to the transfer and processing of your data in countries where we or our service providers operate, including the United States and the European Union.

If you use our services from outside Cyprus, you are responsible for compliance with local laws and regulations.

18. Accessibility

We are committed to making our services accessible to users with disabilities. If you encounter accessibility barriers, please contact support@getfynk.io so we can assist you and improve our accessibility features.

19. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, pandemics, or acts of God, government actions, regulations, or sanctions, internet or telecommunications failures, third-party service provider failures, and cyber attacks or security incidents.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remainder of these Terms will remain in full force and effect, the invalid provision will be replaced with a similar enforceable provision, and the overall intent and scope of these Terms will be preserved.

21. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Fynk regarding our services and supersede all prior agreements and understandings.

22. Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the assignee agrees to honor these Terms.

23. Changes to These Terms

We may modify these Terms from time to time to reflect changes in our services or business practices, updates in applicable laws and regulations, or user feedback and service improvements.

For minor changes, we will post them on our website with an updated "Last Updated" date, and continued use of our services constitutes acceptance. For material changes, we will provide 30 days' advance notice via email or in-app notification, prominent notice on our website, and the option to terminate your account if you disagree with the changes.

Changes take effect on the date specified in our notice, or 30 days after notification for material changes.
